Please read these terms carefully before using Averion Ventures services.

By accessing or using Averion Ventures' services, website, or booking platform, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

1. Acceptance of Terms

These Terms & Conditions constitute a legally binding agreement between you ("Client" or "User") and Averion Ventures ("Company," "we," "us"). By booking a ride, using our website, or engaging our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are booking on behalf of another person (e.g., an elderly family member), you accept these terms on their behalf.

2. Services Provided

Averion Ventures provides non-emergency medical transportation, companion rides, and mobility assistance services across Canada. Our services include:

Medical Appointments

Transportation to and from healthcare facilities, clinics, and hospitals.

Companionship Rides

Compassionate support and companionship for elderly and vulnerable individuals.

Wheelchair Accessible

Specially equipped vehicles for passengers with mobility challenges.

General Mobility

Grocery runs, errands, social outings, and other transportation needs.

We reserve the right to refuse service to any individual who poses a safety risk to our drivers or other passengers, or who violates these terms.

3. Booking & Payment

Booking Confirmation

A booking is confirmed only upon receipt of a confirmation message from Averion Ventures. We reserve the right to decline any booking at our discretion.

Pricing

All prices are in Canadian Dollars (CAD) and include applicable taxes (BC GST 5% + PST 7% = 12%). The base fare of $65 covers the first 15 km. Additional distance is charged at $2.00/km. Wheelchair accessible vehicles incur an additional $15 flat fee.

Payment

Payment is due at the time of booking or as otherwise agreed. We accept major credit cards and other payment methods as listed on our platform.

Price Estimates

Price estimates provided through our calculator are estimates only. Final charges may vary based on actual distance, wait times, and additional services requested.

Receipts

A receipt will be provided via email or SMS upon completion of your ride.

4. Cancellation & No-Show Policy

We understand that plans change. However, our drivers' time is valuable, and cancellations impact their ability to serve other clients.

  • Free Cancellation: Cancel at least 2 hours before your scheduled pickup time at no charge.
  • Short-Notice Cancellation: Cancellations made less than 2 hours before pickup incur a $25 cancellation fee.
  • No-Show: If the driver arrives and the client is not present within 10 minutes, the full fare will be charged.
  • Compassionate Exceptions: We understand emergencies happen. Medical emergencies and extenuating circumstances will be handled on a case-by-case basis.

5. Passenger Conduct

To ensure a safe and respectful environment for everyone, passengers are expected to:

  • Treat drivers with respect and courtesy.
  • Not smoke, vape, or consume alcohol in the vehicle.
  • Wear seatbelts at all times.
  • Refrain from abusive, threatening, or inappropriate behavior.
  • Ensure service animals are properly harnessed. Pets must be in carriers.

Violation of these standards may result in immediate termination of service, forfeiture of fare, and permanent removal from our platform.

6. Limitation of Liability

Averion Ventures carries appropriate commercial vehicle insurance as required by Canadian law. However, to the maximum extent permitted by applicable law:

  • We are not liable for delays caused by traffic, weather, or circumstances beyond our control.
  • We are not responsible for items left in vehicles. Lost items should be reported within 24 hours.
  • Our liability for any claim shall not exceed the total amount paid for the specific ride in question.
  • We do not provide medical advice or emergency medical services. In a medical emergency, call 911.

7. Intellectual Property

All content on the Averion Ventures website, including text, graphics, logos, and software, is the property of Averion Ventures and is protected by Canadian copyright law. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

BC Consumer Rights — Disputes

Nothing in these Terms limits or waives any rights you have under the Business Practices and Consumer Protection Act (BC) or other applicable consumer protection legislation. These statutory rights apply regardless of any agreement between the parties.

  • Step 1 — Good-Faith Resolution: Disputes should first be raised in writing with Averion's support team. We commit to responding within 10 business days.
  • Step 2 — Civil Resolution Tribunal (CRT): If unresolved, disputes within the CRT's monetary jurisdiction may be submitted to the BC Civil Resolution Tribunal at civilresolutionbc.ca.
  • Step 3 — BC Courts: All other disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

Note: We do not require passengers to waive their right to court access as a condition of using our services.

8A. Data Collection & PIPEDA Compliance

Averion Ventures complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and the BC Personal Information Protection Act (PIPA). Personal information is collected only for the purposes described below and only with appropriate consent.

Users may request access to, correction of, or deletion of their personal information at any time by contacting info@averion.ca. We will respond within 30 days as required by PIPEDA.

8B. Data Breach Notification Procedure

In the event of a breach of security safeguards involving personal information that poses a real risk of significant harm, Averion Ventures will:

  • Notify affected individuals as soon as feasible following confirmation of a breach, by direct notification (email or phone) where direct contact information is available.
  • Report to the Office of the Privacy Commissioner of Canada (OPC) as required under PIPEDA's mandatory breach reporting obligations.
  • Maintain a breach record for a minimum of 24 months from the date a breach is determined to have occurred, in compliance with PIPEDA requirements.
  • Take immediate remedial steps to contain the breach and prevent further unauthorized access.

8D. NSC Regulatory Compliance

Averion Ventures operates in compliance with applicable National Safety Code (NSC) standards as adopted by British Columbia under the Commercial Transport Act and the Motor Vehicle Act (BC). All drivers operating under the Averion Verified Driver Program are required to meet applicable NSC requirements, including:

  • NSC Standard 6 — Driver Fitness: Drivers must hold a valid Class 4 (unrestricted) driver's licence as required for passenger transportation in BC.
  • NSC Standard 11B — Preventative Maintenance: All vehicles operating on the platform undergo third-party vehicle inspections consistent with applicable provincial safety inspection standards.
  • Passenger Transportation Licensing: Averion operates in accordance with applicable licensing requirements under the BC Passenger Transportation Act and associated PTL conditions.

9. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised terms. We encourage you to review this page periodically.
